The next four years will call for all of us to stand up for what we believe. The shape of our future can be seen in the bravery of the Standing Rock Sioux, the “Drive for 15” movement, and the opposition to the West Roxbury pipeline. Bill McKibben gives an overview, saying “Volunteering for pain is an unlikely event in a pleasure-based society, and hence it gets noticed. Nonviolent direct action is just one tool in the activist tool kit, and it should be used sparingly—like any tool, it can easily get dull, both literally and figuratively. But when it is necessary to underline the moral urgency of a case, the willingness to go to jail can be very powerful, precisely because it goes against the bent of normal life.” Listen in!

A series of very important events happened very quickly on the Dakota plains last week. After a high profile guard-dog attack on the alliance of Native American activists, a Federal judge rejected the tribe’s legal claim. But almost immediately, the Obama Administration moved to stop pipeline construction. Two days later, an arrest warrant was issued for one of the journalists covering the story. What does this all mean? Can we even tell yet? Listen in as we try to unpack some of the implications of this tumultuous week.

The recent shootings in Louisiana and Minnesota are troubling. There are many American citizens dedicated to the work of eliminating racial bias. Those activists face similar challenges as Climate Hawks, from institutionally powerful adversaries to unthinking ideological opposition. Indeed, in the area of environmental justice, the goals and challenges overlap. Climate Hawks and activists such as the “Black Lives Matter” movement are natural allies, and can support each other in many ways. The easiest way is to recognize each other’s efforts, since both racism and climate change are often difficult topics to inject into the public discussion. The open discussion of either systemic racism or global warming (with it’s systemic abusive pollution) can advance both topics. Listen in as we discuss this important topic.

The Supreme Judicial Court’s sweeping ‘Kain ruling” which
“requires the department [of Environmental Protection] to promulgate regulations that address … sources of greenhouse gas emissions, impose a limit on emissions that may be released, limit the aggregate emissions …, set emission limits for each year, and set limits that decline on an annual basis” is destined to have a dramatic long-term impact on how Massachusetts builds a clean energy economy. On top of that, the court hearing on the President’s Clean Power Plan was delayed until September- but maybe that is a good thing. Listen in!

The Constitution says the President “shall” appoint justices to the Supreme Court, and so he did. This week Mr. Obama nominated Judge Merrick Garland. The President’s Clean Power Plan is on a steady path to the Supreme Court. By June of 2017, the constitutionality of the Plan will be determined. The court making that determination may have only eight members, or it might have a new ninth member who will have a big impact on the final ruling. We discuss the climate implications of who that ninth justice might be, and how it all might play out. (Emphasis on the word might.) Listen in!

In a surprise move, the Supreme Court granted a ‘stay’ thus halting the implementation of the President’s Clean Power Plan. The request came from the AG’s from 27 states who oppose the new clean energy regulations. The Court intervened in the normal legal process for cases like this, perhaps signaling a desire to rebuke the President’s exercise of executive power. What does this all mean?
